58. Vexatious search etc., by officers of Enforcement (1) Any officer of Enforcement exercising powers under this Act or any rule made thereunder who, - (a) without reasonable ground of suspicion, searches or causes to be searched any place, premises, aircraft, vehicle or vessel; or (b) vexatiously detains or searches or arrests any person,.shall, for every such offence, upon conviction by a court, be punishable with imprisonment for a term which may extend to two years or with fine which may extend to ten thousand rupees or with both. (2) Any person wilfully and maliciously giving false information and so causing an arrest or a search to be made under this Act shall, upon conviction by a court, be punishable with imprisonment for a term which may extend to two years or with fine which may extend to ten thousand rupees or with both. |
